Failed a DOT drug test? How the SAP return-to-duty process works

The steps from a positive or refused test back to driving, in plain language.

A positive or refused DOT drug or alcohol test takes you out of safety-sensitive work right away, including driving a CMV. It is not necessarily the end. Federal rules (49 CFR Part 40, Subpart O) lay out a path back called return-to-duty.

Step by step

  1. Removal from duty. You cannot drive a commercial vehicle until the process is finished.
  2. Clearinghouse record. The violation is reported to the FMCSA Drug and Alcohol Clearinghouse. Since November 2024, states also remove the commercial privileges of drivers in "prohibited" status until return-to-duty is complete.
  3. SAP evaluation. You choose a qualified Substance Abuse Professional (SAP). The SAP evaluates you and prescribes education and/or treatment.
  4. Complete the program. You do what the SAP prescribed. The SAP then does a follow-up evaluation to confirm you complied.
  5. Return-to-duty test. You take a directly observed test, and the result must be negative (or below the alcohol limit).
  6. Follow-up testing. After you return, you get unannounced follow-up tests: at least 6 in the first 12 months, and the SAP can extend follow-up testing for up to 5 years.

How long does it stay on your record?

A Clearinghouse violation stays for five years from the date of the violation, or until you finish return-to-duty and all follow-up testing, whichever is later.

Will a carrier hire me after SAP?

Some will, some will not. Among the 48 carriers we recruit for, 15 do not accept drivers with a SAP history, and several review it case by case. Many also want a period of clean driving after you return. If you have completed the process, tell your recruiter early so you only apply where it is accepted.

This page is general information, not legal advice. Your SAP and the FMCSA Clearinghouse are the official sources for your case.
